Privacy Policy for beta program

This is a translation of the German Privacy Policy (Datenschutzerklärung). Should difficulties of interpretation arise, the German text of this Privacy Policy shall be binding.

3. Notes on data processing / definition

3.1. Below we inform you about the processing of your personal data while participating in the beta program and inform you in this regard about your rights as a data subject.

3.2. Only if we subsequently inform you that the provision of personal data is required by law or contract or is required for a contract and you as the data subject are obliged to provide the personal data, these circumstances are present. Automated decision-making or profiling in accordance with Article 22 paragraphs 1 and 4 shall only take place if we explicitly point this out.

3.3. If you do not provide us with the data in the cases outlined below, this would mean that you can not use the service / function or you can not contact us.

4. Data processing in the beta program
4.1. Encryption
To ensure that the processing of your personal data is protected against unauthorised or unlawful processing and against accidental loss, destruction or damage, we will use encryption for the transmission of data (SSL or TLS).

4.2. The storage of the data
To be able to participate in the Beta program, we will need the following information from you. These are needed to give you access to the Beta releases and to inform you about new versions.

-        Name
-        Discord Username
-        Devicemodel
-        Operatingsystem and version
-        UserId
-        Email Address of Google Play Store / Apple Store Useraccount

The data will be stored in Google Docs. Provider of Google Docs is Google, Inc. (hereinafter referred to as "Google"), 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA.

Purpose of processing (Verarbeitungszweck): The processing of the above data is required in order to communicate with you, give you access to a Beta-Version and to improve the product.

Legal basis (Rechtsgrundlage): We have a legitimate interest in the processing of data within the meaning of article 6 Para. 1 lit. f DSGVO, with the legitimate interest of the above-mentioned purpose.

Storage duration (Speicherdauer): The data will be deleted as soon as the stored data can no longer meet the purpose. The time is determined for the individual case.

4.3. Contact - General
If you contact us (e.g. by E-Mail, Fax), we will store the provided data, such as your name, E-Mail address and any other contact information.

Purpose of processing (Verarbeitungszweck): The processing of the above data is necessary in order to answer your contact.

Legal basis (Rechtsgrundlage): The processing of the data will vary depending on the request, possibly on different legal bases supported. But in any case the processing for the protection of our legitimate interests within the meaning of article 6 Para. 1 lit. f DSGVO required. The legitimate interest is based on the fact that we want to fulfill the purpose of the processing.

Storage duration (Speicherdauer): The data will be deleted as soon as the stored data no longer meets the purpose. The time is determined for the individual case. Provided that any legal claims according to § 199 of the German civil code are barred or a law enforcement is also due to Statute of limitation (§§ 78, 79 of the penal code).

5. Notes to the affected person

Due to the processing of your personal data, you are the affected Person with the meaning of DSGVO and it is to you to use the following rights, where we are referred to below as the "responsible person":

-           Right for information (Recht auf Auskunft), Art. 15 DSGVO

You have the right to demand information from the responsible person, whether personal data is processed. If so, you have a right to access the information listed in article 15 DSGVO.

-           The right to correction of personal data (Recht auf Berichtigung der personenbezogenen Daten), Art. 16 DSGVO

You have, in accordance with article 16 of the DSGVO the right over the responsible person of correction or completion of personal data, to the extent that your personal data is inaccurate or incomplete.

-           Right to deletion (Recht auf Löschung), Art. 17 DSGVO

In accordance with the provisions of article 17 DSGVO you have the right to request deletion of your personal data from the responsible person.

-           Right to restriction of processing (Recht auf Einschränkung der Verarbeitung), Art. 18 DSGVO

As a data subject you have, under the conditions of article 18 DSGVO the right to request from the responsible person the restriction of the processing.

-           Right to information (Recht auf Unterrichtung), Art. 19 DSGVO

The affected person has the right under article 19 DSGVO to be informed about the recipients the personal data was disclosed and whom the responsible person informed about the assertion of the rights to rectification, Erasure or restriction of the affected persons data.

-           Right to data portability (Recht auf Datenübertragbarkeit), Art. 20 DSGVO

Under the conditions of art. 20 DS-GMO, you have the right to receive the relevant personal data in a structured, consistent and machine-readable Format. You have the right to transmit the provided personal data to another responsible person without being obstructed by the responsible person, under the conditions of art. 20 DS-GMO. You have the right to obtain, that the personal data will be transmitted directly by another responsible person, to the extent that this is technically feasible.

-           The right to object against the processing of data (Recht auf Widerspruch gegen die Verarbeitung), Art. 21 DSGVO

In accordance with the provisions of article 21 DSGVO you have the right at any time to demand against the processing of personal data relating to affected person on the basis of article 6 Para. 1 lit. e or lit f. This also applies to a rules-based Profiling. If the personal data is processed for direct marketing purposes, you have the right, at any time, to demand against the processing of personal data concerning the affected person for the purpose of such an advertisement; this also applies to the Profiling, to the extent that it is with such direct advertising.

-           Right not to be an automated decision-making including Profiling (Recht, nicht einer automatisierten Entscheidung einschließlich Profiling unterworfen zu werden), Art. 22 DSGVO

As an affected person under art. 22 DSGVO you have the right not to be a subject solely on automated processing, including Profiling – based decision – , which unfolds as a legal effect or similar significantly effect.

-           Right of withdrawal the data protection Declaration of consent (Recht auf Widerruf der datenschutzrechtlichen Einwilligungserklärung), Art. 7 DSGVO

According to article 7 of the DSGVO you have the right to revoke your consent to the processing of relevant personal data at any time.

-           Right to lodge a complaint with a data protection Supervisory authority (Recht der Beschwerde bei einer Datenschutz-Aufsichtsbehörde), Art. 77 DSGVO

Without prejudice to any other remedies, you have in accordance with article 77 DSGVO the right to lodge a complaint with a Supervisory authority if you believe that the processing of your personal data is a violation against the DSGVO.
